Terms of use

Last updated: October 5, 2026

These terms of use are complemented by the terms of sale (Premium subscription), the privacy policy and the legal notice.

1. Purpose

These terms govern the use of ViaLooma, a road-trip itinerary planning service published by Waypoint Factory SAS, 180 chemin du Plateau, 73240 Avressieux, France (details in the legal notice). Your contract for the service is with Waypoint Factory SAS. By using the service, you accept these terms.

2. Access to the service — free tier and Premium

The service includes a free tier (create, edit and share itineraries, within certain quotas) and a paid Premium subscription that lifts those quotas. The sale of the Premium subscription is governed by the terms of sale (prices, right of withdrawal, cancellation, refunds). Some features (saving, sharing, export, AI assistant) require an account. The sale is operated by Paddle.com Market Ltd (United Kingdom) or Paddle Payments Ltd (Ireland), depending on the market, as the merchant of record: Paddle is your counterparty for the purchase and handles payment, invoicing, VAT and refunds; its buyer terms apply in addition. Paddle, not ViaLooma, is what appears on your bank statement.

3. Minimum age

The service is intended for people aged 16 or over. By creating an account, you confirm that you have reached that age.

4. Account

Sign-in uses an email address and password, or Google / Apple. You are responsible for keeping your credentials confidential and for any action taken through your account. You can delete your account at any time from "My account": deletion removes your data and content and ends any active subscription. The "Download my data" button in "My account" lets you export a copy of your data at any time.

5. What the service is, and what it is not

ViaLooma is a trip-planning aid: it proposes itineraries and places built from open data, which you then edit, complete and approve. The last word is yours: the service replaces neither your own judgement, nor official information, nor what you see on the ground.

A few useful clarifications about what it does not do:

  • It is not a travel agency. We are neither an organiser nor a retailer of travel or holidays: we do not sell, book or arrange any transport, accommodation, rental or activity, and we offer neither packages nor linked travel arrangements within the meaning of Directive (EU) 2015/2302. The Premium subscription gives access to the tool.
  • It is not a navigation system. ViaLooma does not guide you in real time: no voice guidance, no live traffic, no re-routing, no alerts. For navigation, a dedicated application remains the right tool, under its own terms.
  • It is not an official source of information. Road signs, orders issued by the authorities and the instructions of road and site operators prevail over what the application displays.
  • It is not an assistance or rescue service (see "Emergencies" below).
  • It is not professional advice — legal, medical, insurance, administrative or meteorological.

6. Nature of the content and data displayed

Itineraries are automatically generated suggestions built from open data (OpenStreetMap, Wikidata, GeoNames) and from user contributions. We take great care over them, but we cannot guarantee the accuracy, completeness or freshness of what is displayed.

  • Place pages: opening hours, prices, opening seasons, facilities, contact details and access conditions may be inaccurate, out of date, or describe a place that has closed — temporarily, seasonally or for good.
  • Distances and driving times: theoretical estimates that leave out traffic, weather, roadworks, breaks, stops and driving style. Splitting the trip into days is a proposed arrangement, not a promise that it is feasible.
  • Road trace: computed by a routing engine over open map data, which may be incomplete or behind the reality on the ground.
  • Photos: sourced from Wikimedia Commons under their respective licences; they may be old and show a state that has since changed.
  • Place descriptions: partly generated by artificial intelligence, they may contain errors or approximations.
  • Popularity indicators, themes and the "family" marker: automatic rankings, given as a guide; they are neither quality ratings, nor editorial recommendations, nor any guarantee that a place suits your situation.

What is displayed therefore does not amount to a guarantee that a place, a road or a service is open, accessible, available, safe or compliant.

7. While you plan — what to know

We look after the application as best we can, and it evolves continuously; it is nonetheless provided as is. Like any web application, it may contain defects, be momentarily unavailable, behave differently depending on the browser, device or version in use, or sit badly with an extension, a content blocker or a private browsing mode.

Your content and keeping a copy of it. Itineraries, notes, photos or favourites may occasionally be lost or altered: after a technical incident, a defect, an action on your part (deleting a stop, regenerating an itinerary, deleting your account), a clearing of your browser's storage, or through the retention periods set out in the privacy policy — in particular the purge of anonymous drafts after 90 days of inactivity. Deleting an account is final, and undo history stays limited both in time and in the number of steps it holds. As ViaLooma is not meant to serve as a backup or archiving service, it is worth keeping your own copy of what matters: the "Download my data" button in "My account", the printable roadbook and, for Premium subscribers, the GPX export are there for that.

Before you leave. The service needs an internet connection: maps, itinerary generation, place pages and the AI assistant do not work offline, and network coverage may be missing en route (mountains, rural areas, abroad, data roaming). A printed or saved copy of your roadbook, and the essentials noted down somewhere (addresses, phone numbers, bookings), save a lot of trouble — as does a look at official sources for the sensitive points of your route.

8. On the road — what to keep in mind

a) The road, and whether the itinerary is passable

The proposed trace is a suggested route: it does not guarantee that a road is open or passable on the day you travel it. A road may be closed, under construction, prohibited, private, one-way, seasonal (mountain passes closed in winter), unsurfaced, damaged, liable to flooding, or difficult in bad weather.

The computation assumes a standard passenger car: it takes into account neither the dimensions nor the weight of your vehicle — height, width, length, gross weight, trailer, caravan, motorhome or camper van — nor the restrictions that go with them: low bridges and tunnels, weight limits, narrow roads, hairpin bends, bans on large vehicles. Checking that the itinerary suits your vehicle before setting off avoids unpleasant surprises, and if in doubt on the spot, turning back beats forcing your way through.

Nor does it take into account:

  • tolls, road vignettes, paid tunnels and crossings, or the cost of fuel;
  • low-emission and restricted-traffic zones (LEZ, ZFE, Umweltzone, Italian ZTL…), environmental stickers and urban or temporary traffic restrictions;
  • the timetables, seasons, bookings and size limits of ferries, which a leg of the route may use;
  • borders, checks and crossing formalities.

The exported GPX file is an indicative trace: the device or application that reads it may derive a different route, and its guidance is its own publisher's responsibility.

b) Stops, places and activities

Whatever your visit depends on is best checked with the place itself before travelling: opening days and hours, prices, compulsory booking, capacity limits, works or permanent closure.

Some places sit on private property or in a regulated area (nature reserve, national park, listed site, military land, forest estate): access may be prohibited, chargeable or subject to authorisation. Signs, fences and other people's property are to be respected in all circumstances.

The places proposed are neither supervised nor staffed by us, and nothing guarantees that they suit your physical condition, or that of your passengers, your children or your animals. As anywhere outdoors, care remains in order: mountains and cliffs, swimming, currents and tides, rivers, caves and canyons, heat, storms, snow, fire risk or wildlife. The "family" marker and the themes are sorting cues: they are neither a safety guarantee nor an accessibility guarantee, in particular for people with reduced mobility.

Local instructions, municipal and prefectural orders, weather warnings and, abroad, the official travel advice of your country of residence remain the references to go by.

c) Parking, wild camping and campsites

Campsites shown also come from open data: their existence, opening, capacity, services (water, electricity, waste disposal, sanitary facilities) and prices may be inaccurate or out of date, and a listed spot may no longer exist.

A place shown on the map is not permission to park or spend the night there. Overnight parking, bivouacking and wild camping are regulated, and the rules vary from one municipality, protected area and country to another (coastline, forests, national parks, fire-risk areas, municipal orders, private land). Checking locally, following the signs and asking the owner's permission on private land remains the way to go about it.

d) Driving, and using the application while on the move

The application is not made to be consulted at the wheel: holding a phone while driving is dangerous and unlawful in most European countries (in France, article R. 412-6-1 of the Highway Code). Better to stop somewhere safe, or hand the device to a passenger.

Road signs and actual conditions prevail over what the application displays. The traffic laws and regulations of the countries you cross (speed, alcohol, compulsory equipment, rest periods) apply in any event. Displayed driving times account for neither your fatigue nor your own pace: a day's programme is in no way binding, and lightening it always beats pushing on.

e) Accommodation, bookings and third-party services

We book nothing and are party to no contract concluded with a hotel, a campsite, a rental company, a guide or a carrier. Prices, availability, and the terms of sale, cancellation and refund belong to the provider or platform you choose: worth checking before you pay, and keeping afterwards.

f) Formalities, insurance and health

Identity documents and visas, vehicle insurance, travel and repatriation insurance, the European Health Insurance Card, vaccinations, medication, transporting animals and compulsory equipment (hi-vis vest, warning triangle, snow chains, environmental sticker…) vary from country to country and are your responsibility. Official sources are the ones to consult before you leave.

g) Emergencies

ViaLooma is not an emergency, assistance or rescue device and cannot be used to call for help. In an emergency, dial 112 (the European emergency number) or the local emergency number — without relying on network coverage, your battery or the application.

9. Your travel decisions

You remain the judge of whether your trip is feasible, and of each of its stages. It is for you:

  • to adapt the itinerary to your vehicle, your experience, your physical condition and your passengers;
  • to check the information that matters before leaving, and again en route;
  • to give up, turn back or take another road as soon as a situation looks beyond your abilities;
  • to look after the minors and animals travelling with you;
  • to take out insurance suited to your trip.

Your judgement on the spot prevails over the itinerary displayed: if a road, a place or a manoeuvre does not inspire confidence, do not push on — whatever the application proposes.

10. "Looma" AI assistant

The service includes a conversational assistant, "Looma" (trip chat and step chat). When you use Looma, you are interacting with an artificial-intelligence system (Anthropic's Claude model), not with a human being. Replies are generated automatically: they may be inaccurate, incomplete or out of date and are not professional advice — verify important information before you leave. Do not base any safety decision on its answers. Usage is subject to quotas that depend on your plan. How conversations are processed is described in the privacy policy.

11. User content and licence

Your content (itineraries, notes, photos, places you create) remains yours. You grant us a non-exclusive licence to store, reproduce and display it as needed to operate the service — including public display under your pseudonym when you publish an itinerary on the public wall (Share). You warrant that you hold the necessary rights to the content you upload (in particular for photos in which people are identifiable). The licence ends when the content or the account is deleted.

Itineraries published by other users are their content, not ours: we do not check them, and the points made in sections 7 to 9 apply to them in full.

12. Moderation and content reporting

Any published content (public itinerary, photo, created place, note) can be reported to us: via the "Report" button on the content's page or through the contact form, which is also our single point of contact. Describe the content, its address (URL) and the reason for the report. We review every report diligently and without discrimination and may remove or block content that is unlawful or breaches these terms. Removal decisions are reasoned; both the reporter and the author of the content may respond through the same channel and request a review. Manifestly abusive reports may be left unprocessed.

13. Intellectual property and open data

The application, its brand, design and copy are protected. Displayed data comes from open sources under their respective licences: © OpenStreetMap contributors (ODbL), Wikidata (CC0), GeoNames (CC BY). Photos come from Wikimedia Commons; each photo's licence and credit are displayed alongside it. Details in the legal notice.

14. Third-party services

The service relies on third parties and offers outbound links (Booking, Airbnb, Park4night, Google Maps, Waze, Apple Maps…), as well as a map background and a routing engine. Those services are governed by their own terms and their own liability: we do not control them and are not responsible for their content, their availability or the services they sell.

No outbound link is remunerated. Neither the itineraries we propose nor the choice or order of the stops answers to a commercial criterion: they follow our relevance criteria alone.

15. Availability and evolution of the service

We strive to keep the service available at all times but do not guarantee it: planned maintenance, changes, data updates or technical failures may temporarily interrupt access — including while you are travelling, all the more reason to carry a copy of your roadbook. Features may evolve; substantial changes to the detriment of Premium subscribers will be announced in advance.

16. Acceptable use

You agree not to disrupt the service (bulk scraping, circumventing technical limits or quotas, unauthorised access attempts) nor to use it for unlawful purposes.

17. Liability

We provide the service with the care and skill to be expected of a professional. Our obligation concerns the operation of the tool: it extends neither to the accuracy of the open data displayed, nor to whether roads are passable, nor to the condition of the places proposed, nor to how your trip unfolds — all of which depend on third parties and on circumstances beyond our control.

We are therefore not liable for damage that is not attributable to us, in particular damage resulting from inaccurate or out-of-date information from open sources, from your travel or driving decisions, from disregarding the points flagged above, from the act of a third party or a third-party service, or from an event of force majeure. To the extent permitted by law, our liability is limited to direct damage that was foreseeable when the contract was concluded.

Nothing in these terms excludes or limits our liability for wilful misconduct, gross negligence, or death or personal injury, nor any liability that cannot legally be excluded. Your statutory consumer rights, including the legal guarantee of conformity for digital content and services, are unaffected (see the terms of sale).

Force majeure. We are not liable for a failure caused by an event beyond our reasonable control: natural disaster, failure of a network or of an infrastructure provider, cyberattack, conflict, or a decision of a public authority.

18. Termination by the publisher

In the event of a serious or repeated breach of these terms (abuse, fraud, unlawful content), we may suspend or close an account, with prior notice where circumstances allow. An active Premium subscription is governed by the terms of sale.

19. Changes to these terms

These terms may change; the version published on this page, with its update date, prevails. Continued use after a change constitutes acceptance.

20. Governing law

These terms are governed by French law, without prejudice to the mandatory consumer protections of your country of residence in the European Union, which you retain in any event. Failing an amicable resolution, the courts having jurisdiction by law may be seised.

21. Contact

For any question about these terms: through our contact form.
